- ELIGIBILITY: The INTEL® GAME DEVELOPER PROGRAM SWEEPSTAKES (the “Sweepstakes”), sponsored by Dell* computer systems (“Dell” or “Sponsor”) and administered by Intel Corporation (“Intel” or “Administrator”), is open to all legitimate attendees of the GAME DEVELOPER CONFERENCE 2019 (located at the Moscone Center, 747 Howard St., San Francisco, CA. 94103, United States), who are at least eighteen (18) years of age or older, or the age of majority in the entrant’s state or province or territory or country (the “Sweepstakes Territory”), whichever is greater at the time of entry. The Sweepstakes Territory shall include all countries and territories, excluding U.S. embargoed countries or any other country, province/territory or state where prohibited by law.
Employees, officers, directors, or business partners of Intel or Dell*, and any of their respective subsidiaries and affiliated companies, agents, contractors, advertising/promotion agencies, individuals engaged in the development, production, or distribution of materials for, or implementation of the Sweepstakes, and the immediate family members (spouse, siblings, children and parents including foster and step-relations) or those living in their same household (whether or not related) as any person in any of the preceding categories are NOT eligible to enter or win a prize. Employees of the Government and Government-owned entities and any other similar entities are excluded from participation in the Sweepstakes.
By entering, each entrant fully and unconditionally agrees to and accepts these Official Rules, the information provided by the Sponsor and Administrator in connection with the Sweepstakes, and the decisions of the Sponsor or Administrator (and their authorized representatives) which are final and binding with respect to all matters pertaining to this Sweepstakes.
SWEEPSTAKES ENTRY PERIOD: The Sweepstakes begins March 20, 2019 on or about 10:00 a.m. U.S. Pacific Time (“PT”) and ends March 22, 2019 at 2:59 p.m. PT (“Sweepstakes Period”).
HOW TO ENTER: Entries can be completed by visiting the Intel booth during the Sweepstakes Period at the Game Developer Conference 2019 located at the Moscone Center, 747 Howard St., San Francisco, CA. 94103, and subscribing to the Intel® Game Developer Program (the “Dev Program”) by getting your GDC badge scanned. The information collected from your GDC badge will be your first and last name, and email address. The winner must meet the eligibility requirements set forth in these rules in order to qualify for the prize. Limit one (1) entry per person. Entrant may, at any time, opt out of the Dev Program or communications from the Dev Program.
Proof of entry is not proof of its receipt or eligibility for the Sweepstakes; only submissions that have been received and verified by the Administrator (or its authorized representative) within the Sweepstakes Period may be eligible to receive an entry. Participation and prize award are subject to verification and/or determination of all entrants, and any other information required by the Administrator in order to verify a winner.
DRAWING/ODDS: There will be one (1) random drawing resulting in one (1) winner. The odds of winning depend on the number of eligible entries received. On or about March 29, 2019, a potential winner will be selected in a random drawing from among all eligible entries during the Sweepstakes Period. A total of one (1) winner will be selected. The random drawing will be conducted by the Administrator whose decision is final on all matters relating to the drawing. The prize will be shipped by the Sponsor within 30 business days after March 29, 2019 or the date the winner is selected, whichever comes later.
NOTIFICATION OF WINNERS: The potential winner will be notified by email, from email@example.com, no later than March 29, 2019 at 3 p.m. PT and required to complete a prize fulfillment form within 10 business days from the date the notice was sent. In the event of noncompliance, if an entrant is or becomes noncompliant or ineligible or is otherwise disqualified for any reason during or after the Sweepstakes Period, or if a potential winner fails to respond to the email or other notification within the time specified, or if a potential winner fails to complete and return the prize fulfillment form, or a potential winner’s prize fulfillment form is not received for any reasons, or a potential winner declines the prize, or cannot be reached using the contact information from the entry form, the Sponsor will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible entries received throughout the Sweepstakes Period.
PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”): During the Sweepstakes one (1) entrant will be chosen at random by the Administrator. The chosen entrant who is eligible in accordance with these terms and conditions will be awarded with a Dell Precision* 5530 laptop computer with an Intel® Core™ i7-8850H processor (see full product specifications) (the “Prize”). Total ARV of the Prize is $2,400 USD.
The Sponsor reserves the rights to make an equivalent Prize substitution at its sole discretion if the advertised Prize becomes unavailable. Prizes cannot be substituted, assigned, transferred, or redeemed for cash.
Any and an all applicable federal, state, local, provincial, and municipal taxes and all fees, by way of example, shipping fees, and expenses related to acceptance and use of the Prize not specified are the sole responsibility of the individual Prize winner. In the event the Prize winner is a resident of the United States or Washington D.C., he/she will be issued, and must complete, a 1099 tax form for the actual retail value of the prize. In the event the Prize winner is a Sweepstakes Territory resident, he/she will be issued, and must complete, a Form 1042 for the actual retail value of the Prize.
GENERAL CONDITIONS: The Sponsor and Administrator reserve the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond the Sponsor’s and Administrator’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by the Sponsor or Administrator in their sole discretion. The Sponsor and Administrator are not responsible for lost, late, incomplete, damaged, stolen or misdirected entries; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. The Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Warning: Any attempt by an entrant or any other individual to deliberately damage any web site associated with this Sweepstakes or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor and Administrator reserve the right to prosecute and seek damages from any such person to the fullest extent permitted by law. The Sponsor and Administrator reserve the right at their sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, the website, and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Sweepstakes is not capable of running as planned, the Administrator may, in its sole discretion, void any suspect entries and (a) modify the Sweepstakes or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the Prize from among the eligible, non-suspect entries received for the Sweepstakes Period up to the time of the impairment.
Any suspected attempt by any entrant, directly or indirectly, to cheat, engage in fraud, to obtain unauthentic or fraudulent entries, ineligible or inaccurate or untimely submissions, as determined in the Administrator’s sole and absolute discretion, will void all such entries, and disqualify any entrant suspected of using/benefitting from such methods. Without limiting the foregoing, the Administrator has the right to verify entrants’ eligibility and compliance with these Official Rules and, on the basis of its investigation, disqualify any entrant at any time during or after the Sweepstakes Period, and require immediate Prize return, if applicable. The Sponsor and Administrator assume no responsibility for lost, late, incomplete, inaccurate, delayed, destroyed, damaged, illegible, or misdirected entries (in whole or in part), and/or non-compliance.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in this Sweepstakes, entrants agree that the Sponsor, Administrator, and each of their affiliates, subsidiaries, franchisees, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers, web masters, and their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of the Prize.
By participating in this Sweepstakes, entrants agree that the Released Parties will have no liability whatsoever for, and shall be held harmless by entrants against, any liability for any injuries, losses or damages of any kind to persons, including, without limitation, personal injury or death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of the Prize, entry, or participation in this Sweepstakes or in any Sweepstakes related activity, use of THE INTEL® GAME DEVELOPER PROGRAM SWEEPSTAKES or the downloading from and/or printing material downloaded from said or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. The Released Parties are not responsible if the Sweepstakes cannot take place or if the Prize cannot be awarded due to delays or interruptions, acts of God, acts of war, natural disasters, weather or acts of terrorism. Without limiting the foregoing, everything regarding this Sweepstakes, including, without limitation, the above website and the Prize, are provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions may not allow the limitations or exclusions of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply. Check local laws for any restrictions or limitations regarding these limitations or exclusions.
PUBLICITY: Except where prohibited by law, winner grants the Administrator and those acting pursuant to its authority, the right and permission to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner’s name, portrait, picture, voice, likeness, entry and biographical information for advertising, trade, and promotional purposes (including the announcement of his or her name on television or radio broadcast) without additional consideration, compensation, permission, or notification. Entrants agree that the Administrator shall own Entries, which will not be acknowledged or returned, and that the Administrator and its designees shall have the perpetual, worldwide right to edit, publish, and use the entries in any way and in any media for trade, advertising, promotional, and/or other purposes as the Administrator and/or its designees may determine without further consideration to entrants or any third party.
DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes (excluding any and all disputes, claims and causes of action arising out of or connected with the Prize awarded in the Sweepstakes or the use or misuse thereof) shall be resolved individually, without resort to any form of class action, and exclusively by the United States Court for Delaware or the appropriate State Court located in Delaware; (2) any and all disputes, claims and causes of action arising out of or connected with the Prize awarded in the Sweepstakes or the use or misuse thereof shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate courts located in New Castle County, Delaware; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (4) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by, and construed in accordance with, the laws of Delaware, without giving effect to any choice of law or conflict of law rules (whether of Delaware or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Delaware.
