DATES OF PROMOTION:

The “Intel Overdrive Sweepstakes” (the “promotion”) will start at 10:00 a.m. Pacific Time (“PT”) on October 30, 2019 and will end at 11:59 p.m. PT on February 20, 2020 (the “promotion period”). Promotion is subject to the entry periods and drawing dates outlined in the “entry periods” section below. For purposes of these official rules, all times are given in Pacific Time.

ELIGIBILITY:

The promotion is open to Intel® Technology Providers, Intel® Authorized Distributors, original equipment manufacturers, and resellers who are (a) legal residents of one of the fifty (50) United States or the District of Columbia who are at least the age of majority in their state of residence (which is nineteen [19] in Alabama and Nebraska, twenty-one [21] in Mississippi, and eighteen [18] in all other states); or (b) legal residents of Canada (excluding residents of the province of Quebec) who are at least the age of majority in their province or territory of residence at the time of entry (collectively referred to herein as “entrant[s]”). Employees of Intel corporation (the “sponsor”) and their immediate family members (parents, children, siblings, or spouse, regardless of where they live, or persons living in same household, whether related or not), employees of Quango, and each of their respective parent companies, divisions, affiliates, subsidiaries, advertising and promotion agencies, and any others engaged in the development, production, execution, or distribution of this promotion, including but not limited to National Sweepstakes Company, LLC (the “independent administrator”) and the entities supplying the prizes herein (collectively the “promotion entities”), are not eligible to participate. Promotion is subject to all federal, state, and local laws and regulations, and in the case of Canadian entrants shall be governed by and construed in accordance with the applicable laws of Canada (excluding the province of Quebec), without regard to conflict of law provisions. Promotion is void in Puerto Rico, Quebec, US territories, and possessions located outside of the fifty (50) United States and the District of Columbia or Canada, and wherever else restricted or prohibited by law. By entering this promotion, entrant indicates her/his full and unconditional agreement to, and acceptance of these official rules and the decision of the sponsor, which are final and binding in all respects. Winning a prize is contingent upon fulfilling all requirements set forth herein.

ENTRY PERIODS:

There will be seven (7) entry periods (each an “entry period”) held during the promotion period. For each entry period, two (2) entry period prize winners (each an “entry period prize winner”) will be selected at random from among all eligible entries received during the respective entry period. Each entry period prize Winner will win an entry period prize (each an “entry period prize”). At the end of the promotion period (February 20, 2020), three (3) prize winners (each a “prize winner”) will be selected at random from among all eligible entries received during the entire promotion period. Each prize winner will win a prize (the “prize”).

There is a limit of one (1) entry per entrant per training video (each a “training”) completed. Non-winning eligible entries from previous entry periods will carry over to the next entry period. Entrants will receive one (1) entry for each training completed. There is a limit of seven (7) entries per entrant per entry period if an entrant completes all seven (7) Trainings. If an entrant completes all seven (7) trainings, she/he will receive an additional two (2) entries for the overall drawing. An entrant may receive a total of nine (9) entries for the overall drawing.

Each entry period will run from 10:00 a.m. PT on the start date to 11:59 p.m. PT on the end date outlined below. The seven (7) entry periods are:

HOW TO ENTER:

Watch a Training Video: Seven (7) unique training videos will be released at https://www.intel.com/overdrive (the “website”) at the onset of the promotion. Each training video will remain available for the remainder of the promotion period after being released on the website. Entrants may complete the entry process for trainings up to 11:59 p.m. on February 19, 2020 to be eligible for the overall drawing and any current or subsequent entry period drawings.

If entrant is selected to win an entry period prize in any entry period drawing, she/he will no longer be eligible to enter the entry period drawings. Entrant will also receive one (1) entry into the overall drawing for which she/he completes the training. Entrant must watch the training video in order to receive one (1) entry into the respective entry period(s). If entrant does not complete all of the required steps, aborts the process before it is complete, or intentionally un-configures before the process is complete, she/he will not be eligible to win.

Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different identities and/or any other methods will void that entrant’s entries and that entrant may be disqualified from the promotion. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be disqualified.

The promotion entities are not responsible for any entry that is lost, late, misdirected, or undeliverable, whether due to system errors, omissions, interruptions, deletions, defects, delays in operation or transmissions or any other reason, theft or destruction or failures, faulty transmissions or other telecommunication malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, technical malfunctions, or otherwise. No mechanically or programmatically reproduced entries are permitted. Late entries or entries sent via any other method will not be accepted. All entries become the sole property of the sponsor, and the sponsor has no obligation to acknowledge receipt of or to return any entry received.

WINNING/ODDS:

Entry Period Drawings: In accordance with the dates outlined in the “entry periods” section above, there will be seven (7) random drawings in which two (2) entry period prize winners will be selected from among all eligible entries received during the respective entry period. Odds of winning an entry period prize will depend upon the total number of eligible entries received during the respective entry period.

Overall Drawing: There will be one (1) overall drawing held on or about February 20, 2020. For this overall drawing, three (3) prize winners will be selected from among all eligible entries received during the entire promotion period. Odds of winning a prize will depend upon the total number of eligible entries received during the promotion period.

The awarding of all prizes is subject to verification by the sponsor and independent administrator whose decisions are based upon their sole discretion and interpretation of these official rules and are final and binding in all respects. A potential prize winner is not a winner of any prize, even if the promotion should so indicate, unless and until their eligibility and the potential winning entry have been verified by the sponsor.

PRIZES:

Entry Period Prizes: The following entry period prizes will be awarded per entry period:

  • Entry Period 1: Each entry period prize winner will receive a Nintendo Switch*, having an approximate retail value (“ARV”) of $230USD/$304CDN.
  • Entry Period 2: Each entry period prize winner will receive a Sonos One* speaker, having an ARV of $150USD/$199CDN.
  • Entry Period 3: Each entry period prize Winner will receive a Chromebook*. The first entry period 3 prize winner will receive a Dell Convertible Chromebook*, having an ARV of $227USD/$300CDN. The second entry period 3 prize winner will receive an HP Chromebook, having an ARV of $254USD/$336CDN.
  • Entry Period 4: Each Entry Period Prize Winner will receive an Amazon Echo Show, having an ARV of $230USD/$304CDN.
  • Entry Period 5: Each entry period prize winner will receive a Sony* Noise-Cancelling Headphones, having and ARV of $350USD/$462CDN.
  • Entry Period 6: Each entry period prize winner will receive an Intel® NUC, having an ARV of $663USD/$883CDN.
  • Entry Period 7: Each entry period prize winner will receive a Vizio Soundbar*, having an approximate retail value (“ARV”) of $130USD/$172CDN.

A total of fourteen (14) entry period prizes will be awarded for the entire promotion. Total ARV of all entry period prizes is $2,234USD/$2,960CDN.

Overall Drawing Prizes: The following prizes will be awarded to the three (3) prize winners selected in the overall drawing:

  • One (1) prize of a Dell* XPS 13 10th Generation, having an ARV of $2,000USD/$2,643CDN.
  • One (1) prize of an HP* Elitebook, having an ARV of $1,700USD/$2,246CDN.
  • One (1) prize of a Lenovo* Thinkpad, having an ARV of $1,700USD/$2,246CDN.

The total ARV of all overall drawing prizes is $5,400USD/$7,135CDN

The total ARV of all prizes to be awarded in this promotion is $7,634USD/$10,095CDN.

Names of prize manufacturers are used solely for the purpose of identification of the prize. No endorsement, authorization, sponsorship, or approval by the prize manufacturer is intended or implied.

There is a limit of one (1) entry period prize per person/household. An entry period prize winner is eligible to win a prize. Each prize winner agrees that all prizes are being provided “as is,” and the released parties (as defined in the “no liability” section below) make no warranty, representation, or guarantee regarding any prize, including but not limited to its quality, condition, merchantability, or fitness for a particular purpose. Each prize winner must look solely to the manufacturer of prizes for any such warranties or guarantees, if any. No transfer, substitution, or cash redemption of prizes is permitted, except at sponsor’s sole discretion or as otherwise provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if prize becomes unavailable due to reasons beyond the control of the sponsor. Each prize winner is solely responsible for any applicable federal, state, and local taxes if applicable. No more than the number of prizes set forth in these official rules will be awarded. All prizes will be awarded.

NOTIFICATION:

Email: Each prize winner will be contacted via email. The prize winner must respond within two (2) days of the notification with specific personal information to include her/his first name, last name, physical address, city, state, ZIP code, email, and date of birth.

In the event the sponsor cannot reach a prize winner via the applicable notification method listed above, a prize winner does not respond by the date indicated within such notification, or it is determined by sponsor, in its sole discretion, that a prize winner is not eligible in accordance with these official rules, such prize winner will be disqualified (without compensation of any kind). An alternate prize winner will be selected at random from among all remaining non-winning eligible entries received per the applicable drawing. Any prize winner who receives a price of $600 or more will be required to complete a release and IRS Form W-9/W-8BEN as defined in the “prize claims” section below. In addition, any prize winner residing in Canada (excluding Quebec) will be required to correctly answer a mathematical skill-testing question (unaided by electronic or mechanical device or otherwise) in order to receive her/his prize.

PRIZE CLAIMS:

Except where prohibited, in addition to supplying the information as outlined in the “notification” section above, each prize winner receiving a prize of $600 or more must sign and return to the independent administrator, within seven (7) days of receipt, an affidavit/declaration of eligibility/release of liability/publicity release (the “release”) and either an IRS form w-9 (us residents only) or IRS form w-8BEN (Canada residents only) in order to claim her/his prize. The release and either IRS form W-9 (US residents only) or IRS Form W-8BEN (Canada Residents only) will be sent to the prize winner via the email address provided to the notification. If the prize winner fails to sign and return the release and IRS Form W-9 (US residents only) or IRS Form W-8BEN (Canada residents only) within the required time period, such prize winner forfeits her/his right to the prize and an alternate prize winner will be selected at random from among all remaining non-winning eligible entries received. The value of the prize may be taxable as income and prize winner is solely responsible for any taxes on the prize, including but not limited to all applicable federal, state, and local taxes that become due with respect to the value of the prize. Prize winner must report income to the IRS. In the event it is deemed during the verification process that the prize winner does not have a unique, personal, and valid social security number for sponsor to report the tax liability associated with acceptance of the prize, such prize winner will be disqualified and another prize winner selected as outlined above. Valid social security numbers will be determined by IRS requirements. The sponsor (or a party acting on its behalf) must report the value of the prize to the IRS in the year the prize is received by the prize winner and will be reported to the prize winner and the IRS in the form of a Form 1099 (US residents) or a Form 1042-S (Canada residents). All applicable taxes on the prize are the sole responsibility of the prize winner.

Entry Period Prizes: Entry period prize winners receiving a prize less than $600 will be automatically shipped her/his entry period Prize upon receipt and verification of the personal information and if Canadian resident, mathematical skill testing question. In the event the entry period prize winner’s entry period prize is returned for any reason, Independent administrator will make a reasonable attempt to contact the entry period prize Winner to obtain the correct mailing address. In the event a correct address is unable to be provided, the entry period prize winner will forfeit the right to her/his entry period prize and an alternate entry period prize winner will be selected at random from among all remaining non-winning eligible entries received during the respective entry period.

GENERAL RULES OF PARTICIPATION:

By participating in this promotion, entrants and prize winners release each and all of the promotion entities from any and all liability, damages, or causes of action (however named or described) with respect to or arising out of participation in the promotion, and/or the receipt or use/misuse of the prizes awarded, including, without limitation, liability for personal injury, death or property damage. By participating in this promotion, entrants agree to be bound by these official rules and the decisions of the sponsor/independent administrator, which are final in all respects and not subject to appeal. Sponsor reserves the right permanently to disqualify from this promotion any entrant it believes has violated these official rules. Winning a prize constitutes permission for sponsor and its agencies to use prize winners’ names, addresses (city & state/province/territory), voices and/or likenesses for purposes of advertising, promotion, and publicity, for this promotion only, without further compensation, unless prohibited by law. Sponsor and/or promotion entities are not responsible for lost, late, misdirected, undeliverable, or incomplete entries, whether due to system errors or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete, or garbled computer or telephone transmissions, typographical, or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Sponsor may prohibit an entrant from participating in the promotion or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the promotion by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten, or harass any other entrants, sponsor, or promotion entities. If for any reason this promotion is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the promotion, then sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the promotion and randomly draw from those entries received up to the cancellation/suspension date. This promotion is governed by the laws of the United States, and for Canadian entrants shall be construed in accordance of the applicable laws of Canada (excluding the province of Quebec), without regard to conflict law provisions or principles. By participating, Canadian entrants consent to the jurisdiction of the courts of Toronto, Ontario, as well as legal proceedings in those courts. Caution: any attempt by a person to deliberately damage or undermine the legitimate operation of the promotion may be in violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to seek remedies and damages (including attorney’s fees) from any such person to the fullest extent of the law, including criminal prosecution. Sponsor’s failure to enforce any term of these official rules shall not constitute a waiver of these provisions.

NO LIABILITY:

By participating, entrants agree to release, discharge, indemnify, and hold harmless the sponsor and promotion entities and each of their respective officers, directors, employees, representatives, and agents (the “released parties”) from and against any claims made by prize winners, entrants, or any other third parties, related in any way to the operation of this promotion as well as any other claims, damages, or liability due to any injuries, damages, or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of any prize or participation in any promotion-related activity or participation in this promotion.
