We first communicated information regarding the U.S. federal contractor vaccine mandate on November 11, 2021. Since then, we have been adding FAQs to be able to provide help to our valued suppliers and subcontractors. We appreciate your patience over the past few months as court cases regarding COVID-19 mandates have progressed. Since both the U. S. federal contractor mandate and the OSHA Emergency Temporary Standard are on hold due to recent court decisions, Intel is not currently subject to a vaccine mandate. We will continue to monitor federal and state mandates and share more information when available. November 11, 2021 Dear supplier partner, Intel’s safety culture is well known, and we are thankful to all our suppliers that have helped the company operate safely throughout the pandemic. Because our suppliers are so critical to our success, we would like to share what Intel is doing to help promote a safe working environment. For the past two years, we have worked to balance our safety commitments with the recognition that healthcare decisions are intensely personal. That is why, until now, we have strongly encouraged and incentivized vaccination against Covid-19 but not mandated it for our employees. Recently, the U.S. federal government introduced stricter Covid-19 vaccination requirements for federal contractors such as Intel. As we navigate these new requirements, I wanted to share what we know today. What the U.S. government is requiring of federal contractors: • All U.S. employees are expected to be vaccinated by January 4, 2022, unless approved for a medical or religious accommodation. (Please see the updated FAQs below for current details on supplier actions and implementation timing.) Expectation for suppliers and subcontractors: • This direction also applies to subcontractors and suppliers at covered workplaces. • To fulfill our collective obligations, we ask that each of your companies develop compliance plans and be prepared to implement by the January 4, 2022 deadline for all employees working at U.S. locations. Additionally, please plan to provide Intel with your attestation certifying your company’s compliance to the federal contractor vaccine requirement. (Please see the updated FAQs below for current details on supplier actions and implementation timing.) The issues we’re all facing exemplify how connected we are as a global community and together we can ensure a safe and compliant workplace. Thank you for taking action to keep yourself, your family, your colleagues, and your community safer. Like our CEO Pat Gelsinger, I am an optimist and believe we will get through this soon and emerge stronger than ever. Best regards, Keyvan Esfarjani Senior Vice President and General Manager Manufacturing, Supply Chain and Operations Updated December 17, 2021 The below FAQs have been added to help provide additional clarity: Question: It has been reported that the Occupational Safety and Health Administration (OSHA) Emergency Temporary Standard and the Executive Order on Ensuring Adequate COVID Safety Protocols for Federal Contractors and the Safer Federal Workforce Task Force Guidance are currently on hold in the U.S. court system. As a result, what are the vaccine mandate expectations for Intel suppliers and subcontractors. Answer: On December 7, a district court in Georgia issued a nationwide preliminary injunction that prohibits the U.S. Government from enforcing the vaccine mandate for federal contractors and subcontractors.
