RULES
  • NO PURCHASE NECESSARY TO ENTER OR BE CHOSEN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF BEING CHOSEN. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
  • The 2010 Engineering Challenge is open to high schools in Oregon and southern Washington. Invitation to participate is by direct email only. Schools fill out the email form and return. Consideration for participation is based on specific criteria outlined in the email. Nine (9) schools will be chosen by Intel, in its sole discretion, to design, engineer and build a unique device to enhance the fan experience. The odds of being selected as one of the participating schools depend on the number of eligible entries received and the discretion of Intel. Upon selection, each school will receive a "fun tool kit", which will include a $400 gift card for supplies. Schools may not assign or otherwise transfer their opportunity to participate in the Engineering Challenge.
  • Each chosen school will be represented by their team. The team size for the exhibition game will be three (3) students and one (1) adult mentor. It is up to the chosen schools to select the teams, but all students working on the device for the chosen school must be students at the chosen school. Employees of Shortstop, LLC (Portland Beavers), Intel Corporation, and any of their respective affiliated companies, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, such employees are not eligible to be on the teams. Teams are allowed (and encouraged) to seek mentors and/or advise from community members, but the students should conceive the conceptual idea and perform the work.
  • The teams from the nine schools chosen to participate will be invited to come to a Portland Beavers game in June 2010 (exact date to be determined in the Portland Beavers reasonable discretion after consultation with Intel) ("Presentation Game") to demonstrate their devices on the baseball field. In addition to the $400 gift card, student team members will each receive two (2) tickets to the Presentation Game. Adult mentors will receive one (1) ticket. Exact seat location of the tickets subject to the Portland Beavers' sole discretion. The schools, adult mentor and/or students on the team are responsible for all expenses associated with the game, unless otherwise indicated.
  • Each teacher and student on the team will be required (or their parent or legal guardian, if under the age of 18) to execute and return liability releases and agreements to indemnify and hold harmless the Portland Beavers and Intel in a form provided by the Portland Beavers before being allowed to participate. Teams may be required to pre-test their devices before the Presentation Game and, if such pre-testing is required by the Portland Beavers in its sole discretion, the participants understand and agree that any device that is deemed unsafe by the Portland Beavers, in its sole discretion, shall not be allowed to participate in the Presentation Game. The following are some additional guidelines regarding the devices:
    • NO GAS POWERED ITEMS will be allowed in PGE Park; Air compression is okay, no more than 80 psi;
    • Devices may include handheld, remote-controlled and/or aerial devices;
    • No Intel or Portland Beavers logos can be placed on the device without the prior written consent of Intel and/or Portland Beavers, as applicable;
    • Documentation for some helpful dimensions of PGE Park will follow.
    • The fair market value of materials used to create device may not exceed $400 US.
  • Teams are required to document their journey via journal, photos and video.
  • Except where prohibited, participation in the Engineering Challenge and demonstration at the Presentation Game constitutes each participant's consent to the publication, dissemination and use of his or her name, photograph, image, likeness and voice by the Portland Beavers, Intel in any media at any time for any purpose without any additional compensation to, permission from or inspection by the participant.
  • By entering the Engineering Challenge, entrants agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Engineering Challenge shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Engineering Challenge, but in no event attorney's fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrants hereby waive all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
  • All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of any entrant, the Portland Beavers and/or Intel, shall be governed by, and construed in accordance with the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules or provisions (whether of Oregon, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Oregon. The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
  • By entering the Engineering Challenge, entrants release Shortstop, LLC (Portland Beavers), Intel Corporation, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Engineering Challenge (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
  • The Intel/Beavers Engineering Challenge is sponsored by the Portland Beavers and Intel Corporation (together "Sponsor"). Sponsor's decisions regarding the selection of the participating schools and all other aspects of the Engineering Challenge shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Rules or in other materials relating to the Engineering Challenge.
