Intel/Trail Blazers Engineering Challenge Rules
 


RULES
  1. NO PURCHASE NECESSARY TO ENTER OR BE CHOSEN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF BEING CHOSEN. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
  2. The Engineering Challenge is open to high schools in Oregon and Southwest Washington. From May 1, 2008 through June 30, 2008, to be considered for participation in the Engineering Challenge, visit http://www.intel.com/community/oregon/eng_challenge.htm, fill out all the requested information and hit “submit”. Nine (9) schools will be chosen by Intel, in its sole discretion, to design, engineer and build a unique t-shirt launcher. The odds of being selected as one of the participating schools depend on the number of eligible entries received and the discretion of Intel. Upon selection, each school will receive a “tool box”, which will include a $400 gift card for supplies. Intel volunteers will be available to help (subject to their availability) during the design period (September to December 2008). Schools may not assign or otherwise transfer their opportunity to participate in the Engineering Challenge.
  3. Each chosen school will be represented by their team. The team size will be three (3) students and one (1) adult mentor. It is up to the chosen schools to select the teams, but all students working on the device for the chosen school must be students at the chosen school. Employees of Trail Blazers Inc., Intel Corporation, the National Basketball Association and its Member Teams, NBA Properties Inc., and each of their respective affiliated companies, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, such employees are not eligible to be on the teams. Teams are allowed (and encouraged) to seek mentors and/or advise from community members, but the students should conceive the conceptual idea and perform the work.
  4. The teams from the nine schools chosen to participate will be invited to come to a Trail Blazers game in December 2008 (exact date to be determined in the Trail Blazers reasonable discretion after consultation with Intel) (“Presentation Game”) to demonstrate their devices on the basketball court. A final team roster must be submitted to Intel no later than December 1, 2008. In addition to the $400 gift card, student team members will each receive two (2) tickets to the Presentation Game. Adult mentors will receive one (1) ticket. All participating schools will have the ability to purchase additional tickets to the game at a discount, subject to availability. Retail value of each game ticket is $17.00. Exact seat location of the tickets subject to the Trail Blazers’ sole discretion. The schools, adult mentor and/or students on the team are responsible for all expenses associated with the game, unless otherwise indicated.
  5. Each teacher and student on the team will be required (or their parent or legal guardian, if under the age of 18) to execute and return liability releases and agreements to indemnify and hold harmless the Trail Blazers and Intel in a form provided by the Trail Blazers before being allowed to participate. Teams may be required to pre-test their devices before the Presentation Game and, if such pre-testing is required by the Trail Blazers in its sole discretion, the participants understand and agree that any device that is deemed unsafe by the Trail Blazers, in its sole discretion, shall not be allowed to participate in the Presentation Game. The following are some additional guidelines regarding the devices:


    1. NO GAS POWERED ITEMS will be allowed in the Rose Garden Arena ("Arena");
    2. Devices may include handheld, remote–controlled and/or aerial devices;
    3. No Intel or Trail Blazer logos can be placed on the device without the prior written consent of Intel and/or Trail Blazers, as applicable;
    4. Device should be able to deliver t–shirts to fans at all levels of the Arena. Please see enclosed document for some helpful dimensions of the Arena;
    5. Device should be built to handle objects ranging from size and weight of a 4" diameter foam ball to a rolled up X–Large T–shirt; and
    6. The fair market value of materials used to create device may not exceed $400 US. A complete list of materials and costs must be submitted to Intel by November 7, 2008;

  6. Teams are required to document their journey via journal, photos and video.
  7. Except where prohibited, participation in the Engineering Challenge and demonstration at the Presentation Game constitutes each participant’s consent to the publication, dissemination and use of his or her name, photograph, image, likeness and voice by the Trail Blazers, Intel and/or the National Basketball Association and its Member Teams, NBA Properties Inc. in any media at any time for any purpose without any additional compensation to, permission from or inspection by the participant.
  8. By entering the Engineering Challenge, entrants agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Engineering Challenge shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Engineering Challenge, but in no event attorney's fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrants hereby waive all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out–of–pocket expenses.
  9. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of any entrant, the Trail Blazers and/or Intel, shall be governed by, and construed in accordance with the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules or provisions (whether of Oregon, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Oregon. The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
  10. By entering the Engineering Challenge, entrants release Trail Blazers Inc., Intel Corporation, the National Basketball Association and its Member Teams, NBA Properties Inc., any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Engineering Challenge (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
  11. The Intel/Trail Blazers Engineering Challenge is sponsored by Trail Blazers Inc. and Intel Corporation (together "Sponsor"). Sponsor’s decisions regarding the selection of the participating schools and all other aspects of the Engineering Challenge shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Rules or in other materials relating to the Engineering Challenge.
